Information For People Who Already Filed Their 2020 Tax Return
This law change occurred after some people filed their 2020 taxes. For taxpayers who already have filed and figured their 2020 tax based on the full amount of unemployment compensation, the IRS will determine the correct taxable amount of unemployment compensation. Any resulting overpayment of tax will be either refunded or applied to other taxes owed.
The agency will do these recalculations in two phases.
- First, taxpayers who are eligible to exclude up to $10,200.
- Second, those married filing jointly who are eligible to exclude up to $20,400, and others with more complex returns.
Taxpayers only need to file an amended return if the recalculations make them newly eligible for additional federal tax credits or deductions not already included on their original tax return.
For example, the IRS can adjust returns for taxpayers who claimed the earned income tax credit and, because the exclusion changed their income level, may now be eligible for an increase in the EITC amount.
However, taxpayers would have to file an amended return if they did not originally claim the EITC or other credits but are now eligible to claim them following the change in the tax law. Taxpayers can use the EITC Assistant to see if they qualify for this credit based upon their new taxable income amount. If they now qualify, they should consider filing an amended return to claim this money.
These taxpayers may want to review their state tax returns as well.

Receiving unemployment benefits is no different from earning a paycheck when it comes to income taxes, at least under normal circumstances when the U.S. isnt struggling with a pandemic. Unemployment income is considered taxable income and must be reported on your tax return. It is included in your taxable income for the tax year.
While the federal government tweaked this rule in 2020 in response to COVID-19, those who collected unemployment income in 2021 should expect to pay the full taxes on those benefits. As of January 2022, the federal government and the Internal Revenue Service have not said that the rule would be tweaked again.
Heres what to know about paying taxes on unemployment benefits in tax year 2021, the return youll file in 2022.
Stimulus Checks And Expanded Unemployment Benefits
The COVID-19 pandemic has led to severe economic hardship, with millions of Americans losing their jobs. As a response, Congress passed key legislation that expanded unemployment benefits and delivered direct stimulus payments to provide economic relief. The key thing to understand is that you do not pay taxes on stimulus payments, whereas you do pay taxes on unemployment insurance.

Tax Treatment Of Unemployment Compensation
Unemployment compensation is taxable. However, the American Rescue Plan Act of 2021 allows an exclusion of unemployment compensation of up to $10,200 for individuals for taxable year 2020. In the case of married individuals filing a joint Form 1040 or 1040-SR, this exclusion is up to $10,200 per spouse. To qualify for this exclusion, your adjusted gross income must be less than $150,000. This threshold applies to all filing statuses and it doesnt double to $300,000 if you are married and file a joint return. Any unemployment compensation in excess of $10,200 should still be included on the tax return as taxable income.
Tax Treatment Of 2020 Unemployment Compensation

Irs: Unemployment Compensation Is Taxable Have Tax Withheld Now And Avoid A Tax

WASHINGTON With millions of Americans now receiving taxable unemployment compensation, many of them for the first time, the Internal Revenue Service today reminded people receiving unemployment compensation that they can have tax withheld from their benefits now to help avoid owing taxes on this income when they file their federal income tax return next year.
Withholding is voluntary. Federal law allows any recipient to choose to have a flat 10% withheld from their benefits to cover part or all of their tax liability. To do that, fill out Form W-4V, Voluntary Withholding RequestPDF, and give it to the agency paying the benefits. Don’t send it to the IRS. If the payor has its own withholding request form, use it instead.
If a recipient doesn’t choose withholding, or if withholding is not enough, they can make quarterly estimated tax payments instead. The payment for the first two quarters of 2020 was due on July 15. Third and fourth quarter payments are due on September 15, 2020, and January 15, 2021, respectively. Expanded unemployment benefits, which ended on Labor Day in 2021, provided a lifeline for millions throughout the pandemic. However, if you received any jobless benefits at all last year, you might be in for a shock when you file your taxes.

How To Pay Federal Income Taxes On Unemployment Benefits
Perhaps the easiest way to pay taxes on unemployment compensation is to have federal income taxes withheld from your weekly payments. To have federal income taxes withheld, file Form W-4V with your states unemployment office so it will withhold taxes.
If you request tax withholding, the state will withhold 10% of each paymentno other amounts or percentages are allowed.
Another option is to make estimated quarterly payments by mailing a check with IRS Form 1040-ES or making a payment online via IRS Direct Pay. However, this option is fairly high-maintenance compared to having tax withheld from your unemployment benefits.
First, you need to estimate the amount youll owe using your tax software or the worksheet accompanying Form 1040-ES. Then you need to make four quarterly payments, generally due April 15, June 15, Sept. 15 and Jan. 15 of the following year.
The final option is to wait until you file your tax return to see how much youll owe. However, this option can be risky because it can leave you with a large tax bill and underpayment penalties in April.
If You Owe Tax You Cant Pay
Many Americans find themselves in a position where they still need every cent of those unemployment checks for living expenses, in which case theres no money left to send to the IRS for quarterly estimated tax payments. You might still have options if this is the case.
The IRS suggests paying what you can and reaching out to take advantage of one of its payment options to deal with the balance. You can ask for an installment agreement and pay off your tax debt on balances of up to $50,000 over 72 months, according to Capelli.
Making the request is a simple matter of filing Form 9465 with the IRS. This will at least cut the 0.5% per month late-payment penalty to 0.25%, although the effective interest rate will continue at 3% .
You might also look into an offer in compromise to settle your tax debt for less than the full amount you owe, or ask the IRS for a temporary delay in collecting if your financial situation is particularly difficult. But youll almost certainly need the help of a tax professional to exercise either of these options.
Capelli strongly recommended against taking out a loan to pay your tax bill except as a last resort.
Do not, under any circumstances, borrow money unless its interest-free, Capelli said. Dont use a credit card to pay your taxes. The IRS interest rate is lower than most credit cards, and the IRS payment plan doesnt appear on your credit report.

What Counts As Unemployment Benefits
In most cases, you will apply for and receive unemployment insurance payments from your state. However, there are other types of benefits funded by the federal government but paid through your state that also fall under the category of unemployment.
Other programs provide unemployment insurance to specific industries, such as railroad unemployment compensation benefits and unemployment assistance under the Airline Deregulation Act of 1978. There are also programs for federal employees and ex-military service members.

The Federal Unemployment Tax Act , with state unemployment systems, provides for payments of unemployment compensation to workers who have lost their jobs. Most employers pay both a Federal and a state unemployment tax. This online tool is available only on IRS.gov, and it can help workers or pension recipients avoid or lessen year-end tax bills or can estimate a refund.
Reporting Unemployment Benefits On Your Tax Return
You report your unemployment compensation on Schedule 1 of your federal tax return in the Additional Income section. The amount will be carried to the main Form 1040. Remember to keep all of your forms, including any 1099-G form you receive, with your tax records.

Unemployment Taxes At The Federal Level
At the federal level, unemployment benefits are counted as part of your income, along with your wages, salaries, bonuses, etc. and taxed according to your federal income tax bracket.
With most income, like wages, taxes are pay-as-you-go. With wages, you are expected to pay taxes on your income as you earn it. As an employee, part of your paycheck is usually automatically deducted to pay your federal income and Social Security taxes. Unlike wages, federal income taxes are not automatically withheld on unemployment benefits.
You are responsible for paying taxes on your unemployment benefits. You can request to have federal taxes withheld, make quarterly estimated tax payments, or pay the tax in full when it is due.
Taxes Deductions And Tax Forms For Unemployment Benefits
Youre responsible for paying federal and state income taxes on the unemployment benefits you receive. The Department of Unemployment Assistance does not automatically withhold taxes, but you may request that taxes be withheld from your weekly benefits when you file your claim.
Your weekly benefits may also be reduced if you have a child support order or if you receive an overpayment on your weekly benefit.

Types Of Disability Policies
There are two types of disability policies.
Short-term policies may pay for up to two years. Most last for a few months to a year.
Long-term policies may pay benefits for a few years or until the disability ends.
Employers who offer coverage may provide short-term coverage, long-term coverage, or both.

Earned Income Tax Credit
The earned income tax credit, or EITC, is a federal income tax credit for working people with low to moderate income. If you earned money through wages or self-employment work before losing your job, you might qualify for this credit in the tax year in which you had eligible income.
But unemployment benefits dont count as earned income for the purpose of the EITC, so if you didnt have any earned income in the tax year, you wont be able to claim this credit. Eligibility also depends on other factors, including your filing status, the number of qualifying children you can claim, and the amount of your earned income.
The credit is refundable, meaning that, in addition to reducing the amount you owe, it could give you a refund over the amount of tax you paid in.

What If I Didnt Collect Unemployment Benefits In 2020 But I Still Received A Form 1099g
Considering EDD has already confirmed its paid out more than $10 billion in fraudulent claims, there will certainly be tax forms going out to people whose identities have been used to file fake claims.
If you get a form documenting funds you never received, EDD says to call 1-866-401-2849, but I would encourage people to use the online tool versus trying to call, said Amy Spivey, director of the UC Hastings Low-Income Taxpayer Clinic.
If you feel there is an error on your 1099G form and cant get an amended one from EDD before filing time, make sure you dont report that income when you file your taxes.
According to Spivey, if theres a mismatch between the earnings on your return and a 1099G the IRS has for you in its system, youll likely get a notice flagging underreported income. “And then at that point, you could respond directly to the IRS as well,” advised Spivey. The downside of that, she said, is that if you’re eligible for a refund, it could delay it.
