Already Filed A Tax Year 2020 Tax Return

Tips for filing taxes with unemployment benefits

In most cases, if you already filed a 2020 tax return that includes the full amount of your unemployment compensation, the IRS will automatically determine the correct taxable amount of unemployment compensation and the correct tax. If you paid more than the correct tax amount, the IRS will either refund the overpayment or apply it to other outstanding taxes owed or other debts. The IRS began performing the corrections starting in May 2021 and continues to review tax year 2020 returns and process corrections to issue any applicable refund that is due. If the exclusion of unemployment compensation now qualifies you for deductions or credits not claimed on your original return, you should file an amended return. For example, if you did not claim the Earned Income Tax Credit on your originally filed return because your AGI was too high, and the special exclusion allowed for unemployment compensation received in tax year 2020 reduced your AGI, you should file an amended return to claim the EITC if now eligible.

Exception: If you have qualifying children and received a CP08 or CP09 notice stating you may be eligible for the Additional Child Tax Credit or Earned Income Tax Credit, you do not need to file an amended return. Instead, you can simply respond to the notice if you are eligible for the credit.

What Can You Do If You Receive A Smaller Refund

Filing Taxes While Unemployed

You still need to file your taxes even if you were unemployed for the entire year. It will indicate to the IRS whether or not you received unemployment benefits, as well as if you wish to claim any tax credits or deductions.

The good news is you have multiple options for how you file your taxes and pay for tax liability.

Taxpayers may decide to have the taxes owed withheld from upcoming unemployment compensation, or unemployed individuals may decide to pay estimated quarterly taxes to avoid a bigger lump sum at the end of the year.

Under the CARES Act the $2.2 trillion stimulus package you can receive an additional 13 weeks of unemployment benefits. Information Needed For Your Federal Income Tax Return

Each January, we mail an IRS Form 1099-G to individuals we paid unemployment benefits during the prior calendar year. The 1099-G form provides information you need to report your benefits. Use the information from the form, but do not attach a copy of the 1099-G to your federal income tax return because TWC has already reported the 1099-G information to the IRS. You can file your federal tax return without a 1099-G form, as explained below in Filing Your Return Without Your 1099-G.

A 1099-G form is a federal tax form that lists the total amount of benefits TWC paid you, including:

  • Unemployment benefits
  • Federal income tax withheld from unemployment benefits, if any
  • Alternative Trade Adjustment Assistance and Reemployment Trade Adjustment Assistance payments

Q: How do I access the 1099-G tax form if I am the representative of a deceased claimant?

A: For the New York State Department of Labor to provide you with information belonging to a deceased unemployment insurance claimant, you must first show that you are legally authorized to receive this information. Authorization often comes from the New York State Surrogate Court, and may be one of the following:

If the deceased claimant had no assets, or all property owned by the deceased claimant was owned in common with someone else, then no Executor or Administrator may have been appointed.     If your state, county, or city collects income tax on your unemployment benefits, keep your Form 1099-G for reference. You may have to attach it to your state, county, or local income tax return. If so, keep a copy for yourself.

    Check with your states Department of Revenue and relevant county and local government tax agency for instructions on how to report your unemployment benefits at the state and local level.

    Why Did The Irs Send Refunds From Unemployment Compensation Received In 2020

    The COVID-19 relief legislation known as the American Rescue Plan was signed into law by President Joe Biden in March 2021. The law allowed for a tax break: The first $10,200 of 2020 jobless benefits was made nontaxable income for the 2020 tax year.

    However, many Americans had already filed their taxes by the time the law was passed, meaning that millions overpaid taxes on their unemployment income and were owed money back.

    The IRS began sending additional tax refunds for those unemployment corrections in May 2021, and it announced in Nov. 2021 that it had issued 430,000 additional refunds. The Jan. 6 announcement shows the full scale of the corrections, with nearly 12 million total refunds related to 2020 unemployment compensation.

    Americans whose returns were corrected by the IRS should receive a special letter explaining the changes. But now that the IRS has finished correcting 2020 tax returns, if you overpaid taxes on unemployment income for that year, you’ll need to file an amended tax return to claim it.

    Keep in mind that the tax break is for individuals who earned less than $150,000 in adjusted gross income and only for unemployment insurance received during 2020 and not in 2021. Also note that the IRS could have seized the refund to cover a past-due debt, such as unpaid federal or state taxes and child support.
