What Am I Entitled To And How Can I Claim

Unemployment benefit is calculated as the sum of a fixed part and a variable part. The fixed part equals the 23.27% of the Minimum monthly wage and now it is EUR 149.39.

The variable part of the benefit is 38,79% of the average monthly insured income of the unemployed for the first 3 months 31,03% for the next 3 months and 23,27% for the following 3 months. The average monthly insured income of the unemployed is calculated over the 30 months prior to registration with the Employment Service.

Unemployment benefit cannot be less than 23.27% of the minimum monthly wage and cannot exceed 58.18% of the average national wage.

The COVID-19 pandemic has sent unemployment to its highest levels since the Great Depression, and older workers have been particularly hard hit, with one in five over age 55 now out of work, according to one estimate.

Many people continue to work beyond retirement age, either by choice or out of necessity, at the same time that they receive Social Security benefits. Other older workers are now being forced to take their benefits early after losing their jobs .

Many states reduced unemployment benefits of those receiving Social Security retirement benefits by up to 50 percent, something called the Social Security offset. But after AARP and the National Unemployment Law Project pushed to have these laws overturned, this is no longer the case. In 2015, Illinois became the last state to repeal the Social Security offset.

Income That Reduces Or Delays Payment

Certain types of income may delay or reduce weekly benefits. However, the maximum amount of benefits available is not reduced. If you have applied for, or are receiving, any of the following types of income, you must report it to the Minnesota Unemployment Insurance Program.

Severance pay, wages in lieu of notice, retention pay, or any other payments made because of separation from employment

Holiday pay

Vacation / Sick / Personal Time Off pay

If you retire from your base period employer, your monthly pension payments will reduce your unemployment benefits dollar for dollar. Example: A pension of $433 per month = $100 per week, so UI benefits would be reduced $100 per week.

Payments from a 401K or other pension plan, will not affect your unemployment benefits if any of these conditions apply:

  • You received the payment in a lump sum and you are subject to a penalty for early withdrawal
  • You received the payment in a lump sum and you roll all of it into another retirement fund without taking a payment
  • The payment is from a fund that none of your base period employers paid into .

Can I Receive Both Unemployment And Social Security

The answer is yes. Generally, unemployment insurance doesn’t count Social Security retirement benefits in its income calculations, said Demetra Nightingale, institute fellow at the Urban Institute, a nonpartisan think tank. Other sources of income, such as annuities or investment income, also typically don’t count.

But whether you qualify for unemployment depends on the rules of your state.

“As long as they’re eligible under the state rules … then they would qualify,” Nightingale said.

Some states previously had Social Security offsets, which meant they would reduce unemployment benefits when someone is also receiving Social Security. But those rules have largely been repealed, according to the National Employment Law Project.

Family Maternity And Parental Allowances

While only a few countries had family allowances before World War II and several of the schemes covered employed persons only, with financing by the employer, there was a rapid extension of schemes in the 1940s and 50s. The extension was in large part attributable to the influence of the Beveridge Report in the United Kingdom. Following the British example most of the new schemes in Europe, Canada, and Australasia included all resident children. A second influence was France, which introduced flat-rate family allowances for all children of employed persons in its African coloniesa system also introduced in some Latin-American countries . The majority of schemes cover only employed persons, but a minority, particularly to be found in industrialized countries, pay allowances to all residents. The United States is exceptional among the latter countries in making no provision at all except in aid to dependent children paid on a means-tested basis.

During the 1970s there was a concerted effort in eastern Europe to try to increase the birth rate by increasing the period for which a maternity benefit was paid and by giving in the social insurance scheme to mothers who stayed at home to look after a young child. Similar credits are provided in the United Kingdom for persons who stay at home to care for a child or a disabled relative, but the motive in this case is to increase the personal pension rights of those, particularly women, who have accepted family responsibilities.

Each of the 50 states, the District of Columbia, Puerto Rico, and the U.S. Virgin Islands, administers its own version of the UI program within the general rules of federal law.
